Requirements
(i) cumulative service period of fifteen (15) years, three (3) of which must have been at the grade of Deputy Solicitor General, CSG 4 or in a comparable and relevant position in the public service; (ii) a Bachelor of Laws from a university recognized in Kenya; (iii) a Master of Laws from a university recognized in Kenya; (iv) a post graduate Diploma in Law from Kenya School of Law; (v) admitted as an advocate of the High Court of Kenya; (vi) registered as a member of the Law Society of Kenya and in good standing; (vii) a certificate in a leadership course lasting not less than four (4) weeks from a recognized institution; (viii) demonstrated managerial, administrative and professional competence as reflected in work performance and results; and (ix) exhibited a thorough understanding of national goals, policies, objectives and ability to relate them to the mandate of the Office of the Attorney General.
Duties and responsibilities
An Officer at this level may be deployed to different directorates.
AT CIVIL LITIGATION
An officer at this level will head Civil Litigation Directorate.
Duties and responsibilities will include: - (i) representing the National Government in high profile, contentious, critical, complex strategic and public interest cases in national, regional and international courts and tribunals or in any other legal proceedings to which the National Government is a party other than criminal proceedings; (ii) overseeing development, implementation and review of policies, strategies, legislation, guidelines, frameworks, norms, regulations, plans, standards and programmes in the Directorate; (iii) prosecuting and defending high profile, contentious, critical, complex strategic and public interest cases on behalf of the government in national and international courts, Alternative Dispute Resolution fora and tribunals; (iv) providing legal expertise and protecting public interest by appearing as a friend of the court (amicus curiae) in any civil proceedings to which the Government is not a party; (v) overseeing drafting, filing, service of pleadings and correspondences to the courts within the prescribed statutory timelines; (vi) defending public interest in proceedings of any suit or inquiry of an administrative body which the Attorney-General considers to be of public interest or involves public property and involves the legislature, the Judiciary or an independent department or agency of the Government; (vii) coordinating institution and prosecution of execution proceedings in court against judgement debtor where the government is the decree holder; and (viii) representing the Hon.
Attorney-General and providing legal advice in meetings, multi-agency committees, workshops, task forces, tribunals, boards of state corporations and working groups; and
At LEGISLATIVE DRAFTING
An officer at this level will head Legislative Drafting Directorate.
Duties and responsibilities will include: - (i) overseeing delivery of legislative drafting services in the Directorate; (ii) supervising the drafting of legislative proposals; (iii) supervising the drafting of subsidiary legislation, notices of appointment to offices in the public service, state corporations and constitutional offices; (iv) overseeing the preparation of the Finance Bill; (v) coordinating the rendering of legal advice to Government Ministries, Departments, Constitutional Commissions and State Corporations on legislative and other legal matters; (vi) liaising with the Government Printer on publication of vellum copies of Bill and subsidiary legislation in the Kenya Gazette; (vii) overseeing the issuance of legal advisories to facilitate the passage of Bills in Parliament; (viii) overseeing the preparation of legislation and other legal instruments for regional and international organizations to which Kenya is a party; (ix) ensuring representation of the Office of the Attorney General and provision of legal advice in meetings, multi-agency committees, workshops, taskforces, tribunal, boards of state corporations and working groups; and (x) overseeing the development and implementation of innovations in legislative drafting and law revision
At REITERATIVE SERVICES
Duties and responsibilities at this level will include: - (i) spearheading the review and overseeing legal matters pertaining to the registration of marriages, societies, books, newspapers, magazines and heraldries; (ii) overseeing development, implementation and review of laws, regulations, policies, rules, guidelines, strategies, standards, norms, principles, frameworks, plans, programmes and procedures in the directorate; (iii) overseeing registration of marriages, societies, books and newspapers, adoptions and heraldic representations; (iv) prosecuting and defending disputes arising from the registration services and produce documents in court; (v) undertaking capacity building, public education and awareness on registration of marriages, societies, books and newspapers, adoptions and heraldries; (vi) overseeing revenue collection in the directorate; (vii) undertaking alternative dispute resolution in all matters regarding registration services; and (viii) managing the custodianship of the seal of the Registrar General and original documents in respect to marriages, societies, books and newspapers, adoptions and coat of Arms
AT JUSTICE AND CONSTITUTIONAL AFFAIRS
Duties and responsibilities at this level will include: - (i) overseeing the development, implementation and review of policies, legislation, regulations, guidelines strategies, frameworks, norms, plans, standards and programmes for human rights and fundamental freedoms, the rule of law, criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes policy, constitutional implementation, democratic governance, access to justice, and legal education; (ii) advising the Government on matters relating to human rights and fundamental freedoms, the rule of law, criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes policy, constitutional implementation, democratic governance, access to justice, and legal education; (iii) overseeing the drafting of legal opinions and legal briefs, cabinet memorandum, and statutory instruments on matters relating to human rights and fundamental freedoms, the rule of law, criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes policy, constitutional implementation, democratic governance, access to justice, and legal education; (iv) approving legal advisories to Justice and Legal Affairs Committee to facilitate the passage of Bills in the National Assembly and the Senate; (v) collaborating with development partners and other relevant stakeholders under the GJLOS to promote the mandate of the Office of the Attorney General; (vi) ensuring harmonious Inter-agency collaboration and coordination within the GJLOS; (vii) overseeing effective development, implementation and review of GJLOS reform plans, programmes and projects; and (viii) overseeing the monitoring, evaluation and implementation of policies, legislation, regulations, strategies, frameworks, norms, plans, standards and programmes for the promotion of human rights and fundamental freedoms, the rule of law, criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes, constitutional implementation, democratic governance, access to justice, and legal education
AT TREATIES, AGREEMENT AND ADVISORY
Duties and responsibilities at this level will include: - (i) spearheading development, implementation and review of policies, strategies, legislation, guidelines, frameworks, norms, regulations, plans, standards and programmes in the Directorate; (ii) overseeing negotiation of commercial contracts, financing agreements, procurement contracts; (iii) coordinating negotiation of local, regional and international documents, agreements and treaties for and on behalf of the MDAs; (iv) coordinating interpreting of local, regional and international documents, agreements and treaties for and on behalf of the MDAs; (v) overseeing negotiation of Host Country Agreements, Trade Related Agreements, Bilateral Investment Treaties and Avoidance of Double Taxation Agreements in collaboration with the National Treasury and Economic Planning and other relevant MDAs; (vi) overseeing collaboration with MCDAs to keep custody of international documents, agreements and treaties signed for or on behalf of the Government of Kenya; (vii) coordinating negotiation of international criminal justice and judicial cooperation agreements including Agreements on Mutual Legal Assistance, Extradition and Transfer of Sentenced Persons; and (viii) coordinating the drafting, vetting and reviewing of international criminal justice and judicial cooperation agreements including Agreements on Mutual Legal Assistance, Extradition and Transfer of Sentenced Persons; and
AT PUBLIC TRUSTEE
Duties and responsibilities will include: - (i) overseeing administration of estates of deceased persons; (ii) ensuring prudent management of Public Trustee beneficiary funds; (iii) overseeing administration of trusts for minors and persons living with mental disability; (iv) signing and sealing of transfer documents of movable and immovable assets in relation to estates of deceased persons and trusts; (v) presiding over alternative dispute resolution in succession and trust matters; (vi) coordinating passing of accounts in court for purposes of being discharged from administrator duty upon completion of administration of an estate; (vii) overseeing administration of work injury benefits and accident compensation funds in respect of deceased persons; (viii) ensuring prudent management of enemy property; (ix) managing custodianship of the seal of the Public Trustee and original documents in respect of estates of deceased persons and trusts; (x) overseeing management of income generating properties and other immovable property registered in the names of deceased persons and trusts;
AT ADVOCATES COMPLAINTS COMMISSION (ACC) SECRETARIAT
Duties and responsibilities at this level will include: - (i) spearheading the development, implementation and review of policies, strategies, legislation, guidelines, frameworks, norms, regulations, plans, standards and programmes at the Secretariat; (ii) advising the Attorney General on issues relating to the advocates’ discipline and practice of the legal profession; (iii) ensuring that all Commission papers are accurately written, are relevant and are availed to the Commissioners in good time; (iv) coordinating the receiving, reviewing and investigation of complaints against advocates, firms of advocates or any member or employee thereof; (v) overseeing the effective resolution of complaints that are not aggravated in nature through Alternative Dispute Resolution (ADR) mechanisms; (vi) ensuring effective prosecution of cases of professional misconduct that are aggravated in nature at the Disciplinary Tribunal; (vii) overseeing the effective Implementation of the Disciplinary Tribunal orders; (viii) coordinating the vetting of advocates seeking government appointments or those seeking to offer services to government and other institutions; and (ix) overseeing the conduct of legal research on discipline and practice in the legal profession;
