Requirements
(i) cumulative service period of fifteen (15) years, three (3 of which must have been at the grade of Chief State Counsel, CSG 5 or in a comparable and relevant position in the wider Public service; (ii) a Bachelor of Laws from a university recognized in Kenya; (iii) a Master of Laws from a university recognized in Kenya; (iv) post graduate Diploma in Law from Kenya School of Law; (v) admitted as an Advocate of the High Court of Kenya; (vi) registered as a member of the Law Society of Kenya and in good standing; (vii) a Certificate in a leadership course lasting not less than four (4) weeks from a recognized institution; (viii) demonstrated managerial, administrative and professional competence as reflected in work performance and result; and (ix) exhibited a thorough understanding of national goals, policies, objectives and ability to relate them to the mandate of the Office of the Attorney General.
Duties and responsibilities
An Officer will be deployed in any of the directorates. Duties and responsibilities will include: -
AT CIVIL LITIGATION
An officer at this level may be deployed to head any of the following Departments:- (i) Public Law; (ii) Private Law; (iii) Specialized Courts; or (iv) Field Services.
Duties and responsibilities will include: - (i) representing the National Government in high profile, contentious, critical, complex strategic and public interest cases in national, regional and international courts and tribunals or in any other legal proceedings to which the National Government is a party other than criminal proceedings; (ii) coordinating development, implementation and review of policies, strategies, legislation, guidelines, frameworks, norms, regulations, plans, standards and programmes in the Department; (iii) prosecuting and defending high profile, contentious, critical, complex strategic and public interest cases on behalf of the government in national and international courts, Alternative Dispute Resolution fora and tribunals; (iv) providing legal expertise and protecting public interest by appearing as a friend of the court (amicus curiae) in any civil proceedings to which the Government is not a party; (v) coordinating recovery of civil debts owed to the Government; (vi) spearheading Business Process Re-engineering in the Department; and (vii) overseeing client satisfaction survey on services offered;
AT LEGISLATIVE DRAFTING
An officer at this level may be deployed to head any of the following functional areas: (i) public Finance, Social Services and Law Revision; or (ii) natural Resources, Administration and Development.
Duties and responsibilities will include: - (i) coordinating delivery of legislative drafting services; (ii) supervising the drafting of legislative proposals; (iii) supervising the drafting of subsidiary legislation, notices of appointment to offices in the public service, state corporations and constitutional offices; (iv) coordinating the preparation of the Finance Bill; (v) coordinating the rendering of advice to Government Ministries, Departments, Constitutional Commissions and State Corporations on legislative and other legal matters; (vi) supervising the revision of laws under the Revision of the Laws Act (Cap.
1); (vii) liaising with the Government Printer to ensure publication of vellum copies of Bills and subsidiary legislation in the Kenya Gazette; and (viii) coordinating research on legal and policy matters
AT REGISTRATIVE SERVICES
An officer at this level may regarded as Registrar, Marriages/Societies/Books and Newspapers/ Arms and may be deployed in any of the following functional areas: (i) Registration of Marriages; (ii) Registration of Societies; (iii) Registration of Books and Newspapers; or (iv) College of Arms.
Registration of Marriages
Duties and responsibilities will include: - (i) overseeing registration of Civil, Christian, Hindu, Islamic and customary marriages and divorces; (ii) overseeing development, implementation and review of laws, regulations, policies, rules, guidelines, strategies, standards, norms, principles, frameworks, plans, programmes and procedures in the department; (iii) ensuring notices of intention to marry are published; (iv) dispensing notice requirement and issuing special licences to parties intending to marry; (v) issuing marriage certificates for all registered marriages; (vi) facilitating determination of the rules governing customary marriages; (vii) overseeing issuance of certificates of no impediment to persons who intend to marry and who qualify for such a certificate; (viii) facilitating determination of objections of notices to marry; (ix) appointing marriage officers at national and county levels and a member of the diplomatic staff of Kenya in a foreign country by notice in the Gazette to celebrate civil marriages; (x) facilitating licensing of a minister of faith as a marriage officer; (xi) ensuring that a marriage complies with the provisions of the Act before registration; (xii) considering a marriage certificate issued in a foreign country or such other proof as sufficient before registering a marriage celebrated outside Kenya; (xiii) ensuring a certified copy of a certificate of marriage and adoption is issued;
Registration of Societies
Duties and responsibilities will include: - (i) registering or exempting a society from registration and issuing a certificate of registration or exemption from registration; (ii) overseeing development, implementation and review of laws, regulations, policies, rules, guidelines, strategies, standards, norms, principles, frameworks, plans, programmes and procedures in the department; (iii) considering every application for registration of a society or for exemption from registration and communicate the decision to the society; (iv) granting written permission to a society whose registration or exemption is pending to collect or invite subscriptions or donations to the funds of the society; (v) refusing to register and notify a society of the decision where the application is not compliant with the Societies Act; (vi) cancelling or suspending a registered society which has contravened the Act; (vii) converting any registration made under the Act and granting exemption from registration; (viii) overseeing the publication in the Gazette a notice calling upon a registered society that has ceased to exist to furnish proof of continued existence; and (ix) ensuring the cancellation of the registration or rescinding the exemption of a society that has ceased to exist and publishing in the Gazette notice;
Registration of Books and Newspapers
Duties and responsibilities will include: - (i) overseeing receiving, registration and maintenance of published copies of books, newspapers and magazines; (ii) overseeing the development, implementation and review of laws, regulations, policies, rules, guidelines, strategies, standards, norms, principles, frameworks, plans, programmes and procedures in the department; (iii) maintaining registers of returns in respect of books, newspapers, magazines and bonds; (iv) publishing in the gazette exclusion of any book, newspaper or magazine or any class from the provisions of the Act; (v) overseeing establishment and maintenance of a library or a resource center of all received published copies of books, newspapers and magazines; (vi) approving provision of a certified copy of or an extract of any subsisting entry in a register to any person who may request; (vii) prosecuting and defending suits filed against the Registrar of Books and Newspapers and producing documents before court; and (viii) facilitating alternative dispute resolution mechanisms for any disputes arising under the Act
College of Arms
Duties and responsibilities will include: - (i) considering any application for a grant of arms; (ii) examining and approving design of Arms; (iii) overseeing development, implementation and review of laws, regulations, policies, rules, guidelines, strategies, standards, norms, principles, frameworks, plans, programmes and procedures in the department; (iv) overseeing issuance of a grant and certificate of Arms; (v) registering Arms and delivering to the applicant; (vi) rectifying errors or omissions on grants of Arms upon application by the applicant; (vii) effecting alteration and adjustment of the grant of Arms and Coat of Arms; (viii) ensuring provision of a certified copy of or an extract of any subsisting entry in a register to any person who may request; (ix) prosecuting and defending suits filed against the Registrar of Arms and produce documents before court; (x) representing Office of the Attorney General and providing legal advice in meetings, multi-agency committees, workshops, task forces, tribunals, boards of State Corporations and working groups; and (xi) ensuring Notification in the Gazette of all Arms granted under the Act;
JUSTICE AND CONSTITUTIONAL AFFAIRS
An officer at this level may be deployed to head any of the following functional areas: (i) Human Rights and Legal Education; (ii) Constitution Implementation and Democratic Governance; or (iii) Ethics, Integrity, Anti-Corruption and Economic Crimes Policy.
Human Rights and Legal Education
Duties and responsibilities will include: - (i) overseeing the development, implementation and review of policies, legislation, regulations, guidelines strategies, frameworks, norms, plans, standards and programmes for human rights, fundamental freedoms and legal education; (ii) advising the Government on matters relating to human rights, fundamental freedoms and legal education; (iii) overseeing the drafting of legal opinions and legal briefs, cabinet memorandum, and statutory instruments on matters relating to human rights, fundamental freedoms and legal education; (iv) advising on the formulation and ratification of regional and international treaties, conventions, protocols, multilateral and bilateral agreements to which Kenya is a party; (v) overseeing reporting obligations on human rights treaties, conventions, protocols, multilateral and bilateral agreements to which Kenya is a party; (vi) approving, submitting and defending country reports to regional and international treaty monitoring bodies on the implementation of Kenya’s obligations relating to human rights treaties, conventions, protocols, multilateral and bilateral agreements to which Kenya is a party; (vii) validating legal advisories to Justice and Legal Affairs Committee to facilitate the passage of Bills in the National Assembly and the Senate; (viii) overseeing the dissemination of reports, findings and recommendations of various treaty monitoring bodies on matters relating to human rights, fundamental freedoms to facilitate implementation by state organs, statutory bodies and other stakeholders; (ix) spearheading the design, development and implementation of continuous professional development programmes for state counsel and staff of the Office of the Attorney General on human rights and fundamental freedoms; (x) coordinating the establishment, maintenance and updating of a database on relevant stakeholders, policies, regulations, legislation, framework, programmes and standards; (xi) overseeing the monitoring, evaluation and implementation of policies, legislation, regulations, strategies, frameworks, norms, plans, standards and programmes for the promotion of human rights, fundamental freedoms and legal education;
Constitution Implementation and Democratic Governance
Duties and responsibilities will include: - (i) overseeing the development, implementation and review of policies, legislation, regulations, guidelines strategies, frameworks, norms, plans, standards and programmes for constitutional implementation, democratic governance and access to justice; (ii) advising the Government on matters relating to constitutional implementation, democratic governance and access to justice; (iii) overseeing the drafting of legal opinions and legal briefs, cabinet memorandum, and statutory instruments on matters relating to constitutional implementation, democratic governance and access to justice; (iv) advising on the formulation and ratification of regional and international treaties, conventions, protocols, multilateral and bilateral agreements to which Kenya is a party; (v) approving, submitting and defending country reports to regional and international treaty monitoring bodies on the implementation of Kenya’s obligations relating to democratic governance and access to justice treaties, conventions, protocols, multilateral and bilateral agreements to which Kenya is a party; (vi) overseeing the dissemination of reports, findings and recommendations of various treaty monitoring bodies on matters relating to democratic governance to facilitate implementation by state organs, statutory bodies and other stakeholders; and (vii) promoting the country’s status of compliance with the rule of law, democratic governance and access to justice
Ethics, Integrity and Anti-Corruption and Economic Crimes
Duties and responsibilities will include: - (i) overseeing the development, implementation and review of policies, legislation, regulations, guidelines strategies, frameworks, norms, plans, standards and programmes for the rule of law, criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes; (ii) advising the Government on matters relating to the rule of law, criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes policy; (iii) overseeing the drafting of legal opinions and legal briefs, cabinet memorandum, and statutory instruments on matters relating to the rule of law, criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes policy; (iv) overseeing reporting obligations on the rule of law, criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes to which Kenya is a member; (v) approving, submitting and defending country reports to regional and international treaty monitoring bodies on the implementation of Kenya’s obligations relating to the rule of law, criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes treaties, conventions, protocols, multilateral and bilateral agreements to which Kenya is a party; (vi) spearheading the design, development and implementation of continuous professional development programmes for state counsel and staff of the Office of the Attorney General on the rule of law, criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes policy; (vii) coordinating the establishment, maintenance and updating of a database on relevant stakeholders, policies, regulations, legislation, framework, programmes and standards; and (viii) overseeing the monitoring, evaluation and implementation of policies, legislation, regulations, strategies, frameworks, norms, plans, standards and programmes for the promotion of the rule of law, criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes policy;

International Law Department
Duties and responsibilities will include: - (i) spearheading development, implementation and review of policies, strategies, legislation, guidelines, frameworks, norms, regulations, plans, standards and programmes on international law; (ii) coordinating Government representation in investor-state and commercial arbitration as well as international litigation matters; (iii) coordinating negotiation of local, regional and international documents, agreements and treaties for and on behalf of the MDAs; (iv) overseeing drafting, vetting of local, regional and international documents, agreements and treaties for and on behalf of the MDAs; (v) overseeing negotiation of Host Country Agreements; Trade Related Agreements; Bilateral Investment Treaties and Avoidance of Double Taxation Agreements in collaboration with the National Treasury and Economic Planning and other relevant MDAs; (vi) coordinating drafting, vetting and reviewing of Host Country Agreements; Trade Related Agreements; Bilateral Investment Treaties and Avoidance of Double Taxation Agreements in collaboration with the National Treasury and Economic Planning and other relevant MDAs; (vii) coordinating provision of legal advice on Host Country Agreements; Trade Related Agreements; Bilateral Investment Treaties and Avoidance of Double Taxation Agreements in collaboration with the National Treasury and Economic Planning and other relevant MDAs; (viii) coordinating negotiation of international criminal justice and judicial cooperation agreements including Agreements on Mutual Legal Assistance, Extradition and Transfer of Sentenced Persons; and (ix) overseeing drafting, vetting and reviewing of international criminal justice and judicial cooperation agreements including Agreements on Mutual Legal Assistance, Extradition and Transfer of Sentenced Persons;
Government Transactions Department
Duties and responsibilities will include: - (i) developing, implementing and reviewing of policies, strategies, legislation, guidelines, frameworks, norms, regulations, plans, standards and programmes in the Department; (ii) coordinating the preparation of legal advisories on Cabinet Memoranda; (iii) overseeing the negotiating of complex commercial contracts, financing agreements, procurement contracts and advice the government on transactional projects; (iv) overseeing drafting, vetting, and reviewing of complex commercial contracts, financing agreements, procurement contracts and advice the government on transactional projects; (v) coordinating the preparation of legal advisories of complex commercial contracts, financing agreements, procurement contracts and advice the government on transactional projects; (vi) overseeing negotiation of procurement contracts, financing agreements, Bilateral Investment Treaties and Avoidance of Double Taxation Agreements in collaboration with the National Treasury and Economic Planning and other relevant MDAs; (vii) coordinating drafting, vetting and reviewing Bilateral Investment Treaties and Avoidance of Double Taxation Agreements in collaboration with the National Treasury and Economic Planning and other relevant MDAs; and (viii) representing the Hon.

Legal Advisory and Research Department
Duties and responsibilities will include: - (i) spearheading development, implementation and review of policies, strategies, legislation, guidelines, frameworks, norms, regulations, plans, standards and programmes for legal advisory and research; (ii) coordinating the preparation of legal opinions to MDACs; (iii) overseeing provision of legal advice to MCDAs, Constitutional Commissions, Independent offices, Judiciary, Parliament on all legal matters and emerging areas of law; (iv) overseeing provision of legal advice on Memoranda of Understanding and Cabinet Memoranda; (v) representing the Attorney General and provide legal advice in meetings, multi-agency committees, constitutional commissions, workshops, task forces, tribunals, boards of state corporations and working groups; (vi) coordinating research on all legal matters and emerging areas of law; (vii) overseeing provision of legal advice on policy papers, strategies, frameworks, standards, and guidelines from MDAs; (viii) coordinating undertaking of governance and legal compliance Audits on MDAs; and (ix) overseeing sensitization of MDAs on the mandate of the Department;
PUBLIC TRUSTEE
An officer at this level may be deployed to head any of the following functional areas:- (i) Administration of Estates; (ii) Administration of Trusts; or (iii) Field Services.
Administration of Estates
Duties and responsibilities will include: - (i) coordinating administration of estates of deceased persons; (ii) overseeing management of Public Trustee beneficiary funds; (iii) signing and sealing of transfer documents of movable and immovable assets in relation to estates of deceased persons; (iv) prosecuting and defending succession matters in Court; (v) presiding over alternative dispute resolution in succession matters; (vi) coordinating passing of accounts in court for purposes of being discharged from administrator duty upon completion of administration of an estate; (vii) overseeing administration of work injury benefits and accident compensation funds in respect of deceased persons; (viii) managing custodianship of the seal of the Public Trustee and original documents in respect of estates of deceased persons; (ix) coordinating certification and authentication of grants issued by the Courts, land transfer instruments and other official documents issued under the Law of Succession Act and the Public Trustee Act; and (x) leading teams in formulation and implementation of programmes to raise awareness on law of succession;
Administration of Trusts
Duties and responsibilities will include: - (i) coordinating administration of trusts for minors and persons living with mental disability; (ii) overseeing management of Public Trustee beneficiary funds; (iii) signing and sealing of trusts instruments; (iv) prosecuting and defending trusts matters in Court; (v) ensuring prudent management of enemy property; (vi) acting as Registrar of Wills; (vii) perform the duties of a commissioner under the Waqf Act Cap 109 laws of Kenya; (viii) overseeing management of property of missing persons; (ix) coordinating administration of estates of adults who are incapable of taking decisions by virtue of age, infirmity or any other reason that may be considered by court; (x) coordinating certification and authentication of grants issued by the Courts, land transfer instruments and other official documents issued under the Law of Succession Act and the Public Trustee Act; and (xi) leading teams in formulation and implementation of programmes to raise awareness on trusteeship;
Field Services Department
Duties and responsibilities will include: - (i) coordinating the administration of estates by all Deputy County Commissioners administering estates of deceased persons whose gross value is Kshs.
100,000/= and below in their capacities as ex-officio agents of the Public Trustee; (ii) undertaking training and capacity building of ex-officio agents of the Public Trustee, Assistant County Commissioners, Chiefs, assistant chiefs and other relevant stakeholders on the law of succession and trusteeship; (iii) overseeing management of income generating properties and other immovable property registered in the names of deceased persons and trusts; (iv) coordinating official public events for the Office of the Public Trustee; (v) coordinating Public Trustee County services, Judiciary and other relevant stakeholders; (vi) overseeing management of Public Trustee beneficiary funds; (vii) managing custodianship of the seal of the Public Trustee and original documents; (viii) coordinating certification and authentication of grants issued by the Courts, land transfer instruments and other official documents issued under the Law of Succession Act and the Public Trustee Act; and (ix) coordinating Development, implementation and updating of a database for Public Trustee field services
ADVOCATES COMPLAINTS COMMISSION (ACC) SECRETARIAT
An officer at this level may be deployed to head any of the following functional areas:- (i) Complaints and Investigations; (ii) Prosecution and Dispute Resolution; or (iii) Public Education and Advisory.
Complaints and Investigations
Duties and responsibilities will include: - (i) developing, implementing and reviewing policies, strategies, legislation, guidelines, frameworks, norms, regulations, plans, standards and programs; (ii) receiving, reviewing and investigation of complex complaints against advocates, firms of advocates or any member or employee thereof; (iii) designing and facilitating mechanisms for formal hearings and inquiries by the Commission; (iv) summoning witnesses and any relevant person for appearance before the Commission for cross-examination; (v) referring to courts and other fora complaints that do not disclose a disciplinary offence; (vi) approving recommendations for closure of files; (vii) undertaking due diligence concerning matters of greater public importance, political interest, great economic significance and novel issues of law; (viii) leading teams in the provision of legal opinions and advisories on complaints under review & investigations; (ix) drafting legal opinions and offering advice to instructing clients; (x) updating complainants and advocates on the status of their complaints; (xi) ensuring the attendance of witnesses and any relevant person before the Commission for cross examination; (xii) undertaking due diligence concerning matters of greater public importance, political interest, great economic significance, novel issues of law; (xiii) overseeing designing tools for effective data collection, data analysis and reporting for the Commission’s activities and programs; (xiv) coordinating client satisfaction surveys on services offered at the Commission; (xv) oversee the development, implementation and updating of an e–platform for information and knowledge sharing on advocates complaints; (xvi) coordinating the development, implementation and updating of a database for advocates complaints; and (xvii) negotiating performance targets and conducting appraisals with supervisees;
Prosecution and Dispute Resolution
Duties and responsibilities will include: - (i) coordinating the development, implementing and reviewing of policies, strategies, legislation, guidelines, frameworks, norms, regulations, plans, standards and programs; (ii) presiding or assisting the Commissioner in conducting Alternative Dispute Resolution (ADR) sessions; (iii) leading the parties to a negotiated agreement during the Alternative Dispute Resolution (ADR) sessions; (iv) coordinating the planning and conducting ADR circuits in the counties; (v) promoting and facilitating ADR in the resolution of advocate's disciplinary matters; (vi) overseeing the development, implementation and updating of an e–platform for information and knowledge sharing on advocates complaints; (vii) overseeing compliance of ADR Settlement agreements; (viii) coordinating the drafting of affidavits of charge against accused advocates; (ix) overseeing designing tools for effective data collection, data analysis and reporting for the Commission’s activities and programs; (x) coordinating the development, implementation and updating of a database for advocates complaints; and (xi) prosecuting advocates at the Disciplinary Tribunal and overseeing the preparation and submission of periodic reports
Public Education and Advisory
Duties and responsibilities will include: - (i) coordinating the development, implementing and reviewing of policies, strategies, legislation, guidelines, frameworks, norms, regulations, plans, standards and programs; (ii) overseeing the conduct of research to inform the implementation of short, mid-term and long-term strategic objectives of the Commission; (iii) supervising the designing, development and disseminating of public education and advocacy materials; (iv) overseeing the planning and conduct of public sensitization programs, legal aid clinics, stakeholder forums and guest lectures; (v) providing advice on all legal aspects of the Commission, Regulations and other legal statutes to the instructing clients; (vi) overseeing the Issuance of legal advisories related to legislation, policy and international instruments of the professional conduct and discipline of advocates; (vii) spearheading the sensitization and training of Ministries, Departments, Agencies and the Public on the Advocates disciplinary processes; (viii) managing the legal advisory database; (ix) designing tools for effective data collection, data analysis and reporting for the Commission’s activities and programs; and (x) spearheading the sourcing for appropriate television and radio programs to disseminate information on the Commission’s mandate.
