Requirements
(i) cumulative service period of nine (9) years, three (3) of which must have been at the grade of Principal State Counsel, CSG 7 or in a comparable and relevant position in the wider public service; (ii) a Bachelor of Laws from a university recognized in Kenya; (iii) Post graduate Diploma in Law from Kenya School of Law; (iv) admitted as an Advocate of the High Court of Kenya; (v) registered as a member of the Law Society of Kenya and in good standing; (vi) certificate in a leadership course lasting not less than four (4) weeks from a recognized institution; and (vii) demonstrated administrative and professional competence as reflected in work performance and results.
CIVIL LITIGATION
An officer at this level may be deployed in any of the following functional areas:- (i) Public Law; (ii) Private Law; (iii) Specialized Courts; or (iv) Field Services.
Duties and responsibilities will include: - (i) representing the National Government in public interest cases in national, regional and tribunals or in any other legal proceedings to which the National Government is a party other than criminal proceedings; (ii) developing, implementing and reviewing policies, strategies, legislation, guidelines, frameworks, norms, regulations, plans, standards and programmes in matters related to civil litigation; (iii) prosecuting and defending public interest court cases, including appeals and petitions on behalf of the government in national and regional courts and tribunals; (iv) Providing legal expertise and protecting public interest by appearing as a friend of the court (amicus curiae) in any civil proceedings to which the Government is not a party; (v) representing the national government in public interest cases in Alternative Dispute Resolution including: arbitration, conciliation, mediation, negotiations and adjudication; (vi) drafting, filing, service of pleadings and correspondences to the courts within the prescribed statutory timelines; (vii) defending public interest in proceedings of any suit or inquiry of an administrative body which the Attorney-General considers to be of public interest or involves public property and involves the legislature, the Judiciary or an independent department or agency of the Government; and (viii) initiating recovery of civil debt ligation owed to the Government;
LEGISLATIVE DRAFTING
An officer at this level may be deployed in any of the following functional areas: - (i) Public Finance, Social Services and Law Revision; or (ii) Natural Resources, Administration and Development.
Duties and responsibilities will include: - (i) drafting legislative proposals and subsidiary legislation, notices of appointment to offices in the public service, state corporations and constitutional offices; (ii) Advising Government Ministries/Departments and State Corporations on legislative and other legal matters; (iii) undertaking the revision of laws under the Revision of the Laws Act (Cap.
1); (iv) preparing the Finance Bill and liaising with the Government Printer to ensure publication of vellum copies of Bills and subsidiary legislation in the Kenya Gazette; (v) preparing legal advisories to facilitate the passage of Bills in Parliament; (vi) preparing legislation and other legal instruments for regional and international organisations to which Kenya is a party; (vii) undertaking research on legal and policy matters; and (viii) undertaking Business Process Re-engineering;
REGISTRATIVE SERVICES
An officer at this level may be deployed in any of the following functional areas:- (i) Registration of Marriages; (ii) Registration of Societies; (iii) Registration of Books and Newspapers; or (iv) College of Arms.
Registration of Marriages
Duties and responsibilities will include- (i) Registering Civil, Christian, Hindu, Islamic and customary marriages and divorces; (ii) developing, implementing and reviewing laws, regulations, policies, rules, guidelines, strategies, standards, norms, principles, frameworks, plans, programmes and procedures in the department; (iii) publishing notices of intention to marry; (iv) Issuing Registrar’s certificates after expiration of the statutory period; (v) dispensing notice requirement and issue special licences to parties intending to marry; (vi) Conducting special license interviews for parties getting married under Civil, Christian, Muslims, Hindu, and customary marriages; (vii) Performing civil marriages; (viii) Issuing marriage certificates for all registered marriages; (ix) Determining the rules governing customary marriages; (x) Issuing certificates of no impediment to persons who intend to marry and who qualify for such a certificate; (xi) determining objections of notices to marry; (xii) Licensing a minister of faith as a marriage officer; (xiii) Cancelling a license issued to a marriage officer; and (xiv) Confirming that a marriage complies with the provisions of the Act before registration
Registration of Societies
Duties and responsibilities will include: - (i) Registering or exempting a society from registration and issuing a certificate of registration or exemption from registration; (ii) Developing, implementing and reviewing laws, regulations, policies, rules, guidelines, strategies, standards, norms, principles, frameworks, plans, programmes and procedures in the department; (iii) Granting written permission to a society whose registration or exemption is pending to collect or invite subscriptions or donations to the funds of the society; (iv) Converting any registration made under the Act and granting exemption from registration; (v) Rescinding an exemption of a society from registration; (vi) Publishing in the Gazette a notice calling upon a registered society that has ceased to exist to furnish proof of continued existence; (vii) Cancelling the registration or rescind the exemption of a society that has ceased to exist and publish in the Gazette notice; and (viii) Summoning an official, a member of a society or member of the public to aid in the investigations of offences committed under the Act;
Registration of Books and Newspapers
Duties and responsibilities will include: - (i) Verifying, registering and maintaining published copies of books, newspapers and magazines; (ii) Developing, implementing and reviewing laws, regulations, policies, rules, guidelines, strategies, standards, norms, principles, frameworks, plans, programmes and procedures in the department; (iii) Maintaining and updating registers of returns in respect of books, newspapers, magazines and bonds; (iv) Publishing in the gazette exclusion of any book, newspaper or magazine or any class from the provisions of the Act; (v) Providing a certified copy of or an extract of any subsisting entry in a register to any person who may request; (vi) Prosecuting and defend suits filed against the Registrar of Books and Newspapers and produce documents before court; (vii) Representing Office of the Attorney General and providing legal advice in meetings, multi-agency committees, workshops, task forces, tribunals, boards of State Corporations and working groups; and (viii) Developing, implementing and updating a database for all books, newspapers and magazines;
College of Arms
Duties and responsibilities will include: - (i) Receiving and considering any application for a grant of arms; (ii) Examining design of Arms; (iii) Developing, implementing and reviewing of laws, regulations, policies, rules, guidelines, strategies, standards, norms, principles, frameworks, plans, programmes and procedures in the department; (iv) Advising the applicants on the design of Arms; (v) Suspending or cancelling the application of grant of Arms; (vi) Issuing a grant and certificate of Arms; (vii) Registering Arms and delivering to the applicant; (viii) Filing a copy of grant, maintaining and updating grant register; and (ix) Effecting alteration and adjustment of the grant of Arms and Coat of Arms;
JUSTICE AND CONSTITUTIONAL AFFAIRS
An officer at this level may be deployed in any of the following functional areas: (i) Human Rights and Legal Education; (ii) Constitution Implementation and Democratic Governance; (iii) Ethics, Integrity, Anti-Corruption Strategies and Economic Crimes Policy; or (iv) Governance, Justice, Law and Order Sector.
Human Rights and Legal Education
Duties and responsibilities will include: - (i) Developing, implementing and reviewing policies, legislation, regulations, guidelines strategies, frameworks, norms, plans, standards and programmes for human rights, fundamental freedoms and legal education; (ii) Advising the Government on matters relating to human rights, fundamental freedoms and legal education; (iii) Drafting legal opinions and legal briefs, cabinet memorandum, and statutory instruments on matters relating to human rights, fundamental freedoms and legal education; (iv) Advising on the formulation and ratification of regional and international treaties, conventions, protocols, multilateral and bilateral agreements to which Kenya is a party; (v) Reviewing and submitting country reports on the implementation of Kenya’s obligations relating to human rights treaties, conventions, protocols, multilateral and bilateral agreements to which Kenya is a party; (vi) Coordinating preparation of legal advisories to Justice and Legal Affairs Committee to facilitate the passage of Bills in the National Assembly and the Senate; (vii) Coordinating analysis of cases on matters relating to human and fundamental freedoms, criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes policy, constitutional implementation, democratic governance, access to justice, promotion of quality and legal education for the development of a case digest; (viii) Disseminating reports, findings and recommendations of various treaty monitoring bodies on matters relating to human rights and fundamental freedoms to facilitate implementation by state organs, statutory bodies and other stakeholders; and (ix) Monitoring and evaluating policies, legislation, regulations, strategies, frameworks, norms, plans, standards and programmes for the promotion of human rights, fundamental freedoms and legal education;
Constitution Implementation and Democratic Governance
Duties and responsibilities will include: - (i) Developing, implementing and reviewing policies, legislation, regulations, guidelines strategies, frameworks, norms, plans, standards and programmes for constitutional implementation, democratic governance and access to justice; (ii) Advising the Government on matters relating to constitutional implementation, democratic governance and access to justice; (iii) Drafting legal opinions and legal briefs, cabinet memorandum, and statutory instruments on matters relating to constitutional implementation, democratic governance and access to justice; (iv) Advising on the formulation and ratification of regional and international treaties, conventions, protocols, multilateral and bilateral agreements to which Kenya is a party; (v) Managing the coordination of reporting obligations on democratic governance and access to justice treaties, conventions, protocols, multilateral and bilateral agreements to which Kenya is a party; (vi) Coordinating preparation of legal advisories to Justice and Legal Affairs Committee to facilitate the passage of Bills in the National Assembly and the Senate; (vii) Coordinating analysis of cases on matters relating to human and fundamental freedoms, criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes policy, constitutional implementation, democratic governance, access to justice, promotion of quality and legal education for the development of a case digest; (viii) Monitoring and promoting the country’s status of compliance with the rule of law and the protection of democratic governance; and (ix) Monitoring and evaluating policies, legislation, regulations, strategies, frameworks, norms, plans, standards and programmes for the promotion of constitutional implementation, democratic governance and access to justice;
Ethics, Integrity, Anti-Corruption and Economic Crimes
Duties and responsibilities will include: - (i) Developing, implementing and reviewing policies, legislation, regulations, guidelines strategies, frameworks, norms, plans, standards and programmes for criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes; (ii) Advising the Government on matters relating to criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes policy; (iii) Drafting legal opinions and legal briefs, cabinet memorandum, and statutory instruments on matters relating to criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes policy; (iv) Advising on the formulation and ratification of regional and international treaties, conventions, protocols, multilateral and bilateral agreements to which Kenya is a party; (v) Managing the coordination of reporting obligations on criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes treaties, conventions, protocols, multilateral and bilateral agreements to which Kenya is a party; (vi) Reviewing and submitting country reports on the implementation of Kenya’s obligations relating to criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes treaties, conventions, protocols, multilateral and bilateral agreements to which Kenya is a party; (vii) Coordinating analysis of cases on matters relating to human and fundamental freedoms, criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes policy, constitutional implementation, democratic governance, access to justice, promotion of quality and legal education for the development of a case digest; (viii) Coordinating the design, development and implementation of induction and training programmes for all staff and for public sector legal officers on matters relating to criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes policy, and access to justice; (ix) Monitoring and evaluating policies, legislation, regulations, strategies, frameworks, norms, plans, standards and programmes for the promotion of criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes policy; (x) Undertaking feasibility studies and research on matters relating to criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes policy;
Governance, Justice, Law and Order Sector
Duties and responsibilities will include: - (i) Coordinating the provision of secretariat services to the Governance, Justice, Law and Order Sector (GJLOS); (ii) Collaborating with development partners under the GJLOS and other relevant stakeholders to promote the mandate of the Office of the Attorney General; (iii) Spearheading the strengthening of Inter-agency collaboration and coordination within the GJLOS agencies; (iv) Coordinating the development, implementation and review of GJLOS reform plans, programmes and projects; (v) Organizing joint review meetings on the administration of justice in the GJLOS; (vi) Coordinating establishment and maintenance and updating of an e-platform for knowledge sharing and advocacy on matters relating to the GJLOS; (vii) Coordinating client satisfaction survey on services offered; and (viii) Coordinating maintenance of a risk register for the department; and
TREATIES, AGREEMENT AND ADVISORY
An officer at this level may be deployed in any of the following functional areas: (i) International Law Department; (ii) Government Transactions Department; or (iii) Legal Advisory and Research Department.
International Law Department
Duties and responsibilities will include:- (i) Prosecuting and defending matters on behalf of the government in legal proceedings in international arbitration and international litigation; (ii) Reviewing draft pleadings and legal documents in international arbitration and litigation matters; (iii) Reviewing of draft reports to International and Regional Treaty bodies and organizations to which Kenya is a member; (iv) Negotiating, drafting and vetting of international instruments for and on behalf of MDACs; (v) Interpreting local, regional and international bilateral documents, agreements and treaties for and on behalf of the MDAs; (vi) Providing legal advice on Host Country Agreements, Trade Related Agreements, Bilateral Investment Treaties and Avoidance of Double Taxation Agreements; (vii) Drafting, vetting and reviewing local, regional and international documents, agreements and treaties for and on behalf of the MDAs; (viii) Drafting, vetting and reviewing international criminal justice and judicial cooperation agreements including Agreements on Mutual Legal Assistance, Extradition and Transfer of Sentenced Persons; and (ix) Preparing reports to international and regional treaty bodies and organizations to which Kenya is a member;
Government Transactions Department
Duties and responsibilities will entail: (i) Coordinating provision of legal advisories on Cabinet Memoranda; (ii) Preparing legal advisories to MCDAs and other arms of Government on interpretation and implementation of the Constitution, international instruments, laws, policies, contracts and all legal matters; (iii) Coordinating drafting, vetting, and reviewing of procurement contracts, financing agreements, commercial contracts, specialized contracts and other transactional documents; (iv) Coordinating provision of legal advisories on procurement contracts, financing agreements, commercial contracts, memoranda of understanding, specialized contracts, land transactions instruments and other transactional documents to MCDAs; (v) Negotiating procurement contracts, financing agreements, Bilateral Investment Treaties, PPP Agreements and Avoidance of Double Taxation Agreements in collaboration with the National Treasury and Economic Planning and other relevant MDAs; (vi) Coordinating research on emerging legal issues relating to public finance, public procurement and public private partnerships; (vii) Coordinating legal advice on policy papers and Cabinet Memoranda relating to public procurement and financial issues; and (viii) Conducting legal due diligence on contractors and service providers in consultation with MDAs;
Legal Advisory and Research Department
Duties and responsibilities will entail: (i) Advising Government Ministries, Departments, Agencies, Constitutional Commissions, Independent Offices, County Governments and other arms of Government on all legal matters; (ii) Reviewing legal opinions to MDACs; (iii) Providing legal advice on Memoranda of Understanding and Cabinet Memoranda; (iv) Providing legal advice on policy papers, strategies, frameworks, standards, and guidelines from MDAs; (v) Conducting research on legal and policy matters; (vi) Coordinating capacity building of State Counsel in emerging areas of law; (vii) Preparing the annual State Counsel Colloquium; and (viii) Coordinating the pupillage and post-pupillage programmes;
PUBLIC TRUSTEE
An officer at this level may be deployed in any of the following functional areas: (i) Administration of Estates; (ii) Administration of Trusts; and (iii) Field Services.
Administration of Estates
Duties and responsibilities will include: - (i) Administering estates of deceased persons; (ii) Managing Public Trustee beneficiary funds; (iii) Signing and sealing of transfer documents of movable and immovable assets in relation to estates of deceased persons; (iv) Prosecuting and defending succession matters in Court; (v) Presiding over alternative dispute resolution in succession matters; (vi) Passing accounts in court for purposes of being discharged from administrator duty upon completion of administration of an estate; (vii) Formulating and implementing programmes to raise awareness on law of succession; (viii) Undertaking capacity building on administration of estates; (ix) Developing, implementing and updating of a database for estates administered by the Public Trustee; (x) Undertaking research on legal and policy issues on law of succession; (xi) Developing, implementing and updating of an e–platform for information and knowledge sharing; (xii) Undertaking stakeholder engagement and fostering corporate culture that enhances ethical and good corporate citizenship; (xiii) Preparing speeches, briefs, memoranda and other position papers on law of succession and trusteeship in meetings, workshops, fora, symposiums and conferences; and (xiv) Developing, implementing and reviewing policies, strategies, legislations, guidelines, frameworks, norms, regulations, plans, standards and programmes on administration of estates
Administration of Trusts
Duties and responsibilities will include: - (i) Administering trusts for minors and persons living with mental disability; (ii) Managing Public Trustee beneficiary funds; (iii) Signing and sealing of trusts instruments; (iv) Prosecuting and defending trusts matters in Court; (v) Managing enemy property; (vi) Undertaking custodianship of wills and codicils; (vii) Managing property of missing persons; (viii) Administering estates of adults who are incapable of taking decisions by virtue of age, infirmity or any other reason that may be considered by court; (ix) Presiding over alternative dispute resolution in trusts matters; (x) Formulating and implementing programmes to raise awareness on trusteeship; (xi) Developing, implementing and updating a database for trusts administered by the Public Trustee; (xii) Undertaking research on legal and policy issues on trusteeship; (xiii) Developing, implementing and updating an e–platform for information and knowledge sharing on trusteeship; (xiv) Undertaking stakeholder engagement and fostering corporate culture that enhances ethical and good corporate citizenship; (xv) Preparing speeches, briefs, memoranda and other position papers on law of succession and trusteeship in meetings, workshops, fora, symposiums and conferences; and (xvi) Developing, implementing and reviewing policies, strategies, legislations, guidelines, frameworks, norms, regulations, plans, standards and programmes on administration of trusts
Field Services Department
Duties and responsibilities will include: - (i) Managing Public Trustee beneficiary funds; (ii) Liaising with all Deputy County Commissioners administering estates of deceased persons whose gross value is Kshs.
100,000/= and below in their capacities as ex-officio agents of the Public Trustee; (iii) Managing income generating properties and other immovable property registered in the names of deceased persons and trusts; (iv) Undertaking training and capacity building of ex-officio agents of the Public Trustee, Assistant County Commissioners, Chiefs, Assistant Chiefs and other relevant stakeholders on the law of succession and trusteeship; (v) Liaising with Public Trustee County offices, Judiciary and other relevant stakeholders; (vi) Undertaking research on legal and policy issues on law of succession and trusteeship matters; (vii) Organizing official public events for the Office of the Public Trustee; and (viii) Formulating and implementing programmes to raise awareness on law of succession and trusteeship;
ADVOCATES COMPLAINTS COMMISSION (ACC) SECRETARIAT
An officer at this level may be deployed in any of the following functional areas: (i) Complaints and Investigations; (ii) Prosecution and Dispute Resolution; or (iii) Public Education and Advisory.
Complaints and Investigations
Duties and responsibilities will include: - (i) Receiving, reviewing and investigating complaints against advocates, firms of advocates or any member or employee thereof; (ii) Undertaking formal hearings and inquiries at the Commission; (iii) Referring to courts and other fora complaints that do not disclose a disciplinary offence; (iv) Rendering legal opinions and advisories on complaints under review & investigations; (v) Keeping complainants and advocates informed on the status of their cases; (vi) Summoning witnesses and any relevant person before the Commission for cross examination; (vii) Implementing and updating a database about advocate’s complaints.
(viii) Implementing and updating an e–platform for information and knowledge sharing on advocates complaints; and (ix) Developing, implementing and reviewing policies, strategies, legislations, guidelines, frameworks, norms, regulations, plans, standards and programmes on handling complaints against advocates.
Prosecution and Dispute Resolution
Duties and responsibilities will include: - (i) Preparing files for the conduct of Alternative Dispute Resolution (ADR) sessions; (ii) Subjecting complaints to Alternative Dispute Resolution (ADR) sessions; (iii) Taking minutes and drafting the settlement agreements during the Alternative Dispute Resolution (ADR) sessions; (iv) Following up with compliance of ADR Settlement agreements; (v) Analyzing data, evaluating ADR case files, analyzing negotiated agreements, scrutinizing attendance registers and preparing periodic reports; (vi) Drafting the affidavits of charge against accused advocates; (vii) Prosecuting advocates at the Disciplinary Tribunal and submitting periodic returns; and (viii) Analyzing judgments and preparing the appropriate documents for review or revision and related proceedings where necessary;
Public Education and Advisory
Duties and responsibilities will include: - (i) Undertaking research to inform the implementation of short, mid-term and long-term strategic objectives of the Commission; (ii) Preparing legal advisories on legislation, policy and international instruments on professional conduct and discipline of advocates; (iii) Developing and disseminating public education and advocacy materials; (iv) Planning and conducting public sensitization programs, legal aid clinics, stakeholder fora and guest lectures; (v) Sourcing for appropriate television and radio programs to disseminate information on the Commission’s mandate; (vi) Implementing and updating a data base for the Commission activities; (vii) Evaluating statements made against the Commission and preparing relevant legal advisories for publication; and (viii) Developing, implementing and reviewing policies, strategies, legislations, guidelines, frameworks, norms, regulations, plans, standards and programmes on handling complaints against advocates
