Requirements
(i) cumulative service period of twelve (12) years, three (3) of which should have been at the grade of Deputy Chief State Counsel, CSG 6 or in a comparable and relevant position in the wider public srevice; (ii) a Bachelor of Laws from a university recognized in Kenya; (iii) a Master of Laws from a university recognized in Kenya; (iv) Post graduate Diploma in Law from Kenya School of Law; (v) admitted as an advocate of the High Court of Kenya; (vi) registered as a member of the Law Society of Kenya and in good standing; (vii) certificate in a leadership course lasting not less than four (4) weeks from a recognized institution; and (viii) demonstrated managerial, administrative and professional competence as reflected in work performance and results.
CIVIL LITIGATION
An officer at this level may be deployed to head a division in any of the following functional areas: - (i) Public Law; (ii) Private Law; (iii) Specialized Courts; (iv) Field Services; or (v) Regional Offices.
Duties and responsibilities will include: - (i) representing the National Government in public interest cases in national, regional and tribunals or in any other legal proceedings to which the National Government is a party other than criminal proceedings; (ii) developing, implementing and reviewing policies, strategies, legislation, guidelines, frameworks, norms, regulations, plans, standards and programmes in matters related to civil litigation; (iii) prosecuting and defending public interest court cases, including appeals and petitions on behalf of the government in national and regional courts and tribunals; (iv) providing legal expertise and protecting public interest by appearing as a friend of the court (amicus curiae) in any civil proceedings to which the Government is not a party; (v) representing the national government in public interest cases in Alternative Dispute Resolution including: arbitration, conciliation, mediation, negotiations and adjudication; (vi) spearheading drafting, filing, service of pleadings and correspondences to the courts within the prescribed statutory timelines; and (vii) coordinating the preparation of legal briefs on court matters;
LEGISLATIVE DRAFTING
An officer at this level may be deployed in any of the following functional areas: (i) Public Finance, Social Services and Law Revision; or (ii) Natural Resources, Administration and Development.
Duties and responsibilities will include: - (i) coordinating delivery of legislative drafting services; (ii) supervising the drafting of legislative proposals; (iii) supervising the drafting of subsidiary legislation, notices of appointment to offices in the public service, state corporations and constitutional offices; (iv) coordinating the preparation of the Finance Bill; (v) rendering legal advice to Government Ministries/Departments and State Corporations on legislative and other legal matters; (vi) coordinating the revision of laws under the Revision of the Laws Act (Cap. 1); and (vii) liaising with the Government Printer to ensure publication of vellum copies of Bills and subsidiary legislation in the Kenya Gazette;
REGISTRATIVE SERVICES
An officer at this level may be deployed in any of the following functional areas: (i) Registration of Marriages; (ii) Registration of Societies; (iii) Registration of Books and Newspapers; or (iv) College of Arms.
Registration of Marriages
Duties and responsibilities will include: - (i) coordinating registration of civil, Christian, Hindu, Islamic and customary marriages and divorces; (ii) coordinating development, implementation and review of laws, regulations, policies, rules, guidelines, strategies, standards, norms, principles, frameworks, plans, programmes and procedures in the department; (iii) coordinating publication of notices of intention to marry; (iv) Issuing Registrar’s certificates after expiration of the statutory period; (v) dispensing notice requirement and issuing special licences to parties intending to marry; (vi) coordinating performance of civil marriages; (vii) ensuring issuance of marriage certificates for all registered marriages; and (viii) determining the rules governing customary marriages;
Registration of Societies
Duties and responsibilities will include: - (i) registering or exempting a society from registration and issuing a certificate of registration or exemption from registration; (ii) coordinating development, implementation and review of laws, regulations, policies, rules, guidelines, strategies, standards, norms, principles, frameworks, plans, programmes and procedures in the department; (iii) considering every application for registration of a society or for exemption from registration and communicate the decision to the society; (iv) ensuring updating of a register of societies; (v) granting written permission to a society whose registration or exemption is pending to collect or invite subscriptions or donations to the funds of the society; (vi) refusing to register and notify a society of the decision where the application is not compliant with the Societies Act; (vii) conducting audits and investigations to ensure that registered societies comply with the Societies Act (Cap 108); and (viii) converting any registration made under the Act and granting exemption from registration
Registration of Books and Newspapers
Duties and responsibilities will include: - (i) spearheading receiving, registration and maintenance of published copies of books, newspapers and magazines; (ii) coordinating the development, implementation and review of laws, regulations, policies, rules, guidelines, strategies, standards, norms, principles, frameworks, plans, programmes and procedures in the department; (iii) maintaining registers of returns in respect of books, newspapers, magazines and bonds; (iv) publishing in the gazette exclusion of any book, newspaper or magazine or any class from the provisions of the Act; (v) coordinating establishment and maintenance of a library or a resource center of all received published copies of books, newspapers and magazines; (vi) providing a certified copy of or an extract of any subsisting entry in a register to any person who may request; (vii) prosecuting and defending suits filed against the Registrar of Books and Newspapers and producing documents before court; (viii) coordinating development, implementation and updating of a database for all books, newspapers and magazines; and (ix) coordinating development, implementation and updating mechanisms and tools for basis of refusal, cancellation of registration, seizure of certain books and search of premises
College of Arms
Duties and responsibilities will include: - (i) considering any application for a grant of arms; (ii) examining design of Arms; (iii) coordinating development, implementation and review of laws, regulations, policies, rules, guidelines, strategies, standards, norms, principles, frameworks, plans, programmes and procedures in the department; (iv) advising the applicants on the design of Arms; (v) suspending or cancelling the application of grant of Arms; (vi) coordinating issuance of a grant and certificate of Arms; (vii) registering Arms and delivering to the applicant; (viii) filing a copy of grant, Maintaining and updating grant register; (ix) rectifying errors or omissions on grants of Arms upon application by the applicant; (x) effecting alteration and adjustment of the grant of Arms and Coat of Arms; (xi) coordinating provision of a certified copy of or an extract of any subsisting entry in a register to any person who may request; (xii) providing a certified copy of or an extract of any subsisting entry in a register to any person who may request; (xiii) liaising and collaborating with relevant stakeholders on matters pertaining to registration of heraldries; (xiv) undertaking client satisfaction survey on services offered;
JUSTICE AND CONSTITUTIONAL AFFAIRS
An officer at this level may be deployed in any of the following functional areas: (i) Human Rights and Legal Education; (ii) Constitution Implementation and Democratic Governance; (iii) Ethics, Integrity, Anti-Corruption and Economic Crimes Policy; or (iv) Governance Justice Law Order Sector.
Human Rights and Legal Education
Duties and responsibilities will include: (i) spearheading the development, implementation and review of policies, legislation, regulations, guidelines strategies, frameworks, norms, plans, standards and programmes for human rights, fundamental freedoms and legal education; (ii) advising the Government on matters relating to human rights, fundamental freedoms and legal education; (iii) coordinating the drafting of legal opinions and legal briefs, cabinet memorandum, and statutory instruments on matters relating to human rights, fundamental freedoms and legal education; (iv) advising on the formulation and ratification of regional and international treaties, conventions, protocols, multilateral and bilateral agreements to which Kenya is a party; (v) leading the coordination of reporting obligations on human rights treaties, conventions, protocols, multilateral and bilateral agreements to which Kenya is a party; (vi) reviewing, submitting and defending country reports to regional and international treaty monitoring bodies on the implementation of Kenya’s obligations relating to human rights treaties, conventions, protocols, multilateral and bilateral agreements to which Kenya is a party; (vii) coordinating preparation of legal advisories to Justice and Legal Affairs Committee to facilitate the passage of Bills in the National Assembly and the Senate; (viii) coordinating the dissemination of reports, findings and recommendations of various treaty monitoring bodies on matters relating to human rights, fundamental freedoms to facilitate implementation by state organs, statutory bodies and other stakeholders; (ix) monitoring and promoting the country’s status of compliance with the rule of law and the protection of human rights; (x) undertaking capacity building, civic education and awareness creation on matters relating to human rights, fundamental freedoms, and promotion of quality legal education; and (xi) coordinating the establishment, maintenance and updating of a database on relevant stakeholders, policies, regulations, legislation, framework, programmes and standards
Constitution Implementation and Democratic Governance
Duties and responsibilities will include:- (i) spearheading the development, implementation and review of policies, legislation, regulations, guidelines strategies, frameworks, norms, plans, standards and programmes for constitutional implementation, democratic governance and access to justice; (ii) advising the Government on matters relating to constitutional implementation, democratic governance and access to justice; (iii) coordinating the drafting of legal opinions and legal briefs, cabinet memorandum, and statutory instruments on matters relating to constitutional implementation, democratic governance and access to justice; (iv) advising on the formulation and ratification of regional and international treaties, conventions, protocols, multilateral and bilateral agreements to which Kenya is a party; (v) leading the coordination of reporting obligations on democratic governance and access to justice treaties, conventions, protocols, multilateral and bilateral agreements to which Kenya is a party; (vi) reviewing, submitting and defending country reports to regional and international treaty monitoring bodies on the implementation of Kenya’s obligations relating to democratic governance and access to justice treaties, conventions, protocols, multilateral and bilateral agreements to which Kenya is a party; (vii) coordinating preparation of legal advisories to Justice and Legal Affairs Committee to facilitate the passage of Bills in the National Assembly and the Senate; and (viii) coordinating the dissemination of reports, findings and recommendations of various treaty monitoring bodies on matters relating to democratic governance and access to justice to facilitate implementation by state organs, statutory bodies and other stakeholders;
Ethics, Integrity, Anti-Corruption and Economic Crimes
Duties and responsibilities will include: - (i) spearheading the development, implementation and review of policies, legislation, regulations, guidelines strategies, frameworks, norms, plans, standards and programmes on ethics, integrity, criminal justice policy, criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes; (ii) advising the Government on matters relating to criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes policy; (iii) coordinating the drafting of legal opinions and legal briefs, cabinet memorandum, and statutory instruments on matters relating to criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes policy; (iv) advising on the formulation and ratification of regional and international treaties, conventions, protocols, multilateral and bilateral agreements to which Kenya is a party; (v) leading the coordination of reporting obligations on criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes treaties, conventions, protocols, multilateral and bilateral agreements to which Kenya is a party; (vi) coordinating preparation of legal advisories to Justice and Legal Affairs Committee to facilitate the passage of Bills in the National Assembly and the Senate; (vii) reviewing, submitting and defending country reports to regional and international treaty monitoring bodies on the implementation of Kenya’s obligations relating to criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes policy; and (viii) monitoring and promoting the country’s status of compliance with the rule of law, criminal justice policy, ethics, integrity, anti-corruption strategies and economic crimes policy
Governance, Justice, Law and Order Sector
Duties and responsibilities will include: - (i) overseeing the provision of secretariat services to the Governance, Justice, Law and Order Sector (GJLOS); (ii) spearheading collaboration with development partners under the GJLOS and other relevant stakeholders to promote the mandate of the Office of the Attorney General; (iii) overseeing the strengthening of Inter-agency collaboration and coordination within the GJLOS agencies; (iv) spearheading development, implementation and review of GJLOS reform plans, programmes and projects; (v) coordinating joint review meetings on the administration of justice in the GJLOS; (vi) overseeing the establishment, maintenance, and updating of an e-platform for knowledge sharing and advocacy on matters relating to the GJLOS; (vii) maintaining risk management register in the department; (viii) spearheading implementation of business continuity plans for the department; and (ix) fostering a corporate culture that promotes ethical practices and good corporate citizenship;
TREATIES, AGREEMENT AND ADVISORY
An officer at this level may be deployed in any of the following functional areas: (i) International Law Department; (ii) Government Transactions Department; or (iii) Legal Advisory and Research Department.
International Law Department
Duties and responsibilities will include: - (i) overseeing provision of legal advice on Cabinet Memoranda; (ii) coordinating drafting, vetting, review and negotiation of local, regional and international documents, agreements and treaties for and on behalf of the MDAs; (iii) coordinating interpreting of local, regional and international documents, agreements and treaties for and on behalf of the MDAs; (iv) overseeing negotiation and provision of legal advice on Host Country Agreements; Trade Related Agreements; Bilateral Investment Treaties and Avoidance of Double Taxation Agreements in collaboration with the National Treasury and Economic Planning and other relevant MDAs; (v) leading the prosecution and defence of matters on behalf of the government in legal proceedings in international arbitration and international litigation; (vi) overseeing drafting of legal opinions in international arbitration and international litigation matters; (vii) spearheading coordination of drafting of pleadings in international arbitration and international litigation matters; and (viii) leading attendance of strategy-planning meetings, both local and international, in order to prepare the defence or claim in international arbitration and international litigation matters;
Government Transactions Department
Duties and responsibilities will include: - (i) overseeing provision of legal advisories on Cabinet Memoranda; (ii) overseeing negotiations of procurement contracts, financing agreements, commercial contracts and PPP agreements and other transactional agreements (iii) overseeing drafting, vetting, and reviewing of procurement contracts, financing agreements, commercial contracts, specialized contracts and other transactional documents; (iv) coordinating negotiation of procurement contracts, financing agreements, Bilateral Investment Treaties and Avoidance of Double Taxation Agreements in collaboration with the National Treasury and Economic Planning and other relevant MDAs; (v) spearheading provision of legal advisories on procurement contracts, financing agreements, commercial contracts, memoranda of understanding, specialized contracts, land transactions instruments and other transactional documents to MCDAs; (vi) coordinating the preparation draft Legal Opinion of the Attorney General as a condition precedent to effectiveness of financing agreements; (vii) coordinating research on emerging legal issues relating to public finance, public procurement and public private partnerships; and (viii) overseeing legal advice on policy papers relating to public finance, public procurement and public private partnerships;
Legal Advisory and Research Department
Duties and responsibilities will include: - (i) advising MCDAs, Constitutional Commissions, Independent offices, Judiciary, Parliament on all legal matters; (ii) overseeing provision of legal advice on Memoranda of Understanding and Cabinet Memoranda; (iii) advising on policy papers, strategies, frameworks, standards, and guidelines from MDAs; (iv) representing the Honorable Attorney-General and providing legal advice in meetings, multi-agency committees, constitutional commissions, workshops, task forces, tribunals, boards of state corporations and working groups; (v) undertaking of governance and legal compliance audits on MDAs; (vi) coordinating research on legal and policy matters; (vii) developing of practice and reporting guidelines of Counsel deployed by Human Resources and Management Directorate to Government Ministries, Departments and Agencies; and (viii) preparing practice and reporting guidelines and sensitization of stakeholders; and
PUBLIC TRUSTEE
An officer at this level may be deployed in any of the following functional areas: (i) Administration of Estates; (ii) Administration of Trusts; and (iii) Field Services.
Administration of Estates
Duties and responsibilities will include: - (i) Administering estates of deceased persons; (ii) Managing Public Trustee beneficiary funds; (iii) Signing and sealing of transfer documents of movable and immovable assets in relation to estates of deceased persons; (iv) Prosecuting and defending succession matters in Court; (v) Coordinating passing of accounts in court for purposes of being discharged from administrator duty upon completion of administration of an estate; (vi) Administering work injury benefits and accident compensation funds in respect of deceased persons; (vii) Managing custodianship of the seal of the Public Trustee and original documents in respect of estates of deceased persons; (viii) Leading a team in formulation and implementation of programmes to raise awareness on law of succession; and (ix) developing, implementing and reviewing policies, strategies, legislations, guidelines, frameworks, norms, regulations, plans, standards and programmes on administration of estates
Administration of Trusts
Duties and responsibilities will include: - (i) Administering trusts for minors and persons living with mental disability; (ii) Managing Public Trustee beneficiary funds; (iii) Signing and sealing of trusts instruments; (iv) Prosecuting and defending trusts matters in Court; (v) Coordinating custodianship of wills and codicils; (vi) Managing property of missing persons; (vii) Administering estates of adults who are incapable of taking decisions by virtue of age, infirmity or any other reason that may be considered by court; (viii) Presiding over alternative dispute resolution in trusts matters; (ix) Managing custodianship of the seal of the Public Trustee and original documents in respect of trusts; and (x) Developing, implementing and updating a database for trusts administered by the Public Trustee
Field Services Department
Duties and responsibilities will include: - (i) co-ordinating the administration of estates by all Deputy County Commissioners administering estates of deceased persons whose gross value is Kshs.
100,000/= and below in their capacities as ex-officio agents of the Public Trustee; (ii) undertaking training and capacity building of ex-officio agents of the Public Trustee, Assistant County Commissioners, Chiefs, Assistant Chiefs and other relevant stakeholders on the law of succession and trusteeship; (iii) managing income generating properties and other immovable property registered in the names of deceased persons and trusts; (iv) coordinating official public events for the Office of the Public Trustee; (v) managing Public Trustee beneficiary funds; (vi) liaising with Public Trustee County offices, Judiciary and other relevant stakeholders; (vii) managing custodianship of the seal of the Public Trustee and original documents; (viii) Formulating and implementing programmes to raise awareness on law of succession and trusteeship; and (ix) developing, implementing and reviewing policies, strategies, legislations, guidelines, frameworks, norms, regulations, plans, standards and programmes on administration of estates and trusts;
ADVOCATES COMPLAINTS COMMISSION (ACC) SECRETARIAT
An officer at this level may be deployed in any of the following functional areas: - (i) Complaints and Investigations; (ii) Prosecution and Dispute Resolution; or (iii) Public Education and Advisory.
Complaints and Investigations
Duties and responsibilities will include: - (i) Developing, implementing and reviewing policies, strategies, legislation, guidelines, frameworks, norms, regulations, plans, standards and programs; (ii) Receiving, reviewing and investigation complex complaints against advocates, firms of advocates or any member or employee thereof; (iii) Designing and facilitating mechanisms for formal hearings and inquiries by the Commission; (iv) Referring to courts and other fora complaints that do not disclose a disciplinary offence; (v) Leading teams in the provision of legal opinions and advisories on complaints under review & investigations; (vi) Drafting legal opinions and offering advice to instructing clients; (vii) Updating complainants and advocates on the status of their complaints; and (viii) Ensuring the attendance of witnesses and any relevant person before the Commission for cross examination;
Prosecution and Dispute Resolution
Duties and responsibilities will include: - (i) developing, implementing and reviewing policies, strategies, legislation, guidelines, frameworks, norms, regulations, plans, standards and programs; (ii) Identifying, drawing and communicating the issues for resolution to the disputants; (iii) subjecting complaints to Alternative Dispute Resolution (ADR) sessions; (iv) Presiding or assisting the Commissioner in conducting Alternative Dispute Resolution (ADR) sessions; (v) guiding the parties to a negotiated agreement during the Alternative Dispute Resolution (ADR) sessions; (vi) monitoring compliance of Alternative Dispute Resolution (ADR) Settlement agreements; (vii) planning and undertaking Alternative Dispute Resolution circuits in the counties; and (viii) prosecuting advocates at the Disciplinary Tribunal and submitting periodic reports;
Public Education and Advisory
Duties and responsibilities will include: - (i) developing, implementing and reviewing policies, strategies, legislation, guidelines, frameworks, norms, regulations, plans, standards and programs; (ii) undertaking research to inform the implementation of short, mid-term and long-term strategic objectives of the Commission; (iii) preparing legal advisories on legislation, policy and international instruments on professional conduct and discipline of advocates in the division; (iv) designing, developing, and disseminating public education and advocacy materials; (v) leading a team in formulation and implementation of public sensitization programs, legal aid clinics, stakeholder fora and guest lectures; (vi) rendering advice on all legal aspects of the Commission, Regulations and other legal statutes; (vii) promoting stakeholder engagement and fostering corporate culture that enhances ethical and good corporate citizenship; and (viii) preparing speeches, briefs, memoranda and other position papers on the advocates discipline
